'ADA Education and Reform Act' of 2017

Recently, H.R. 620, the "ADA Education and Reform Act" of 2017 passed the House of Representatives by a vote of 225-192 with bi-partisan support.

The bill will help curb drive-by lawsuits by imposing a notice and cure period before allowing a civil lawsuit to commence in the event of an ADA access violation per Title III of the 1990 landmark legislation. Title III of the ADA prohibits the discrimination on the basis of disability from access to public accommodations. The bill allows 60 days for the owner of the building where the violation occurs to give a written description outlining improvements that will remove the barrier to entry and an additional 60 days for the owner to remove the barrier or make substantial progress to removing the barrier.

BOMA members, many of you included, recently stormed Capitol Hill to promote support for this bill, holding over 200 meetings with legislators and their staff. Such enormous turnout and enthusiasm coupled with BOMA's grassroots groundswell were key markers in our success.

BOMA will begin to work on the bill in the Senate where it has yet to be introduced.
